1. Service Description

PingRCA ("the Service") is an uptime monitoring platform that checks the availability of your websites and web services. When a failure is detected, the Service runs automated diagnostic checks and uses AI-powered analysis to identify the root cause of the outage. The Service is operated by PingRCA ("we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Account Terms

  • You must provide a valid email address to create an account. Email verification is required before you can use the Service.
  • You are responsible for maintaining the security of your account credentials, including your password and API keys.
  • Passwords must meet our minimum security requirements (at least 8 characters).
  • You are responsible for all activity that occurs under your account.
  • You must be at least 13 years of age to use the Service.

3. Acceptable Use

You agree to use the Service only for its intended purpose of monitoring websites and web services that you own or have authorization to monitor. You may not:

  • Use the Service to perform server-side request forgery (SSRF) attacks or attempt to access internal or private network resources.
  • Use the Service to scrape, crawl, or harvest data from websites you do not own or control.
  • Abuse the monitoring infrastructure by creating monitors designed to overload or disrupt target services.
  • Attempt to circumvent plan limits, rate limits, or any other restrictions imposed by the Service.
  • Use the Service for any illegal or unauthorized purpose.
  • Share, resell, or redistribute the Service without our written consent.

4. Billing and Payments

The Service offers both free and paid plans. Paid plans are billed monthly through Stripe, our payment processor. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring monthly basis.

  • Plan limits (number of monitors, check intervals, alert channels) are enforced according to your current subscription tier.
  • You may upgrade or downgrade your plan at any time. Changes take effect at the start of your next billing cycle.
  • Refund policy: We offer prorated refunds for unused service within 30 days of payment. To request a refund, contact us at support@pingrca.com.
  • If payment fails, we will attempt to charge your payment method again. After repeated failures, your account may be downgraded to the free tier.

5. Data Handling

To provide the Service, we collect and store the following data:

  • Account data: Your email address, hashed password, and API keys.
  • Monitor configuration: The URLs you configure for monitoring, along with check interval and alert preferences.
  • Check data: Results of each uptime check, including HTTP status codes, response times, and headers.
  • Incident data: Details of detected outages, including diagnostic probe results and AI root-cause analysis.

6. Data Retention

  • Check data (individual uptime check results) is retained for 30 days from the time of the check.
  • Incident data (outage records and AI analysis) is retained for 90 days from the time of the incident.
  • Account data is retained for as long as your account exists. When you delete your account, all associated data is permanently removed.

7. Service Availability

We strive to maintain high availability of the Service, but we cannot guarantee uninterrupted access. The Service is provided on a best-effort basis.

  • The free tier does not include any service level agreement (SLA).
  • We may perform scheduled maintenance that temporarily affects Service availability. We will provide reasonable advance notice when possible.
  • We are not liable for any downtime, data loss, or other damages resulting from Service unavailability.

8. Intellectual Property

The Service, including its design, code, and branding, is the intellectual property of PingRCA. You may not copy, modify, or redistribute any part of the Service without our written consent.

AI analysis output is yours. The root-cause analysis, diagnostic reports, and any other AI-generated content produced by the Service in connection with your monitors belong to you. You may use, share, or reproduce this output without restriction.

9. Termination

  • By you: You may delete your account at any time through the account settings page. Upon deletion, all your data will be permanently removed.
  • By us: We reserve the right to suspend or terminate your account if you violate these Terms, including but not limited to engaging in abusive use of the Service, attempting SSRF attacks, or failing to pay for your subscription.
  • We will make reasonable efforts to notify you before termination, except in cases of severe or repeated abuse.

10. Limitation of Liability

To the maximum extent permitted by applicable law, PingRCA and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

Our total aggregate liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you via the email address associated with your account. Continued use of the Service after such notification constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the State of California.
